1. INTELLECTUAL PROPERTY

You acknowledge and agree that all content and materials available on this site are protected by copyrights, trademarks, service marks, patents, trade secrets, or other proprietary rights and laws. Except as expressly authorized by COMPANY, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from such materials or content.

2. ABILITY TO ACCEPT TERMS AND CONDITIONS

You affirm that you are either more than 18 years of age, or an emancipated minor, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions, and to abide by and comply with these Terms and Conditions.

3. PAYMENT TERMS AND REFUND POLICY

Payment Methods

We accept the following credit cards: Visa, American Express, MasterCard, and Discover & PayPal. There is no surcharge for using your credit card to make purchases. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order. Your credit card will be billed immediately upon purchase.

General Refund Policy and Damaged Goods

Items that were purchased through COMPANY site can be refunded within 45 days of purchase for a full refund. We are not responsible for the cost of return shipping if the item is returned. Payments made with a credit card will be refunded to the card used for your order. Refunds will not be honored after 45 days.

Damaged and wrongly shipped items may be requested to be returned to us within 45 days at no cost to the purchaser unless there are reasonable circumstances why this cannot be done. In the event you purchase Products that are subject to any limited guarantee based on express language on the Websites (e.g., “45 Day In-Home Trial”), such guarantee, if applicable, shall be limited solely to those Products purchased on the Online Shop and shall not apply to any other products purchased in any other store, account, site, location or channel. For purposes of calculating the relevant time period, the applicable date shall be the date of purchase unless stated otherwise. Any eligible refunds will be paid using the same payment method as the initial purchase.

Delivery

The Items will be delivered within a reasonable time after the receipt of Buyer’s sales confirmation, subject to the availability of furnished goods. Company shall not be liable for any delays, loss, or damage in transit.

Company may, in its sole discretion, without liability or penalty, make partial shipments of Goods to Buyer. Each shipment will constitute a separate sale, and Buyer shall pay for the units shipped whether such shipment is in whole or partial fulfillment of Buyer’s purchase order.

If for any reason Buyer fails to accept delivery of any of the Goods on the date fixed pursuant to notice that the Goods have been delivered, or if Company is unable to deliver the Goods at the Delivery Point on such date because Buyer has not provided appropriate instructions, documents, licenses, or authorizations: (i) risk of loss to the Goods shall pass to Buyer; (ii) the Goods shall be deemed to have been delivered; and (iii) Company, at its option, may store the Goods until Buyer picks them up, whereupon Buyer shall be liable for all related costs and expenses (including, without limitation, storage and insurance).

Non-Delivery

The quantity of any installment of Goods as recorded by Company on dispatch from Company’s place of business is conclusive evidence of the quantity received by Buyer on delivery unless Buyer can provide conclusive evidence proving the contrary.

The Company shall not be liable for any non-delivery of Goods (even if caused by Company's negligence) unless Buyer gives written notice to Company of the non-delivery within 15 days of the date when the Goods would in the ordinary course of events have been received.

Any liability of Company for non-delivery of the Goods shall be limited to replacing the Goods within a reasonable time or adjusting the invoice respecting such Goods to reflect the actual quantity delivered.

Please read the Privacy Policy carefully to understand how COMPANY collects, uses, and discloses personally identifiable information from its users. The Privacy Policy is hereby incorporated by reference as part of these Terms and Conditions.

13. CLASS ACTION WAIVER

ARBITRATION OR ANY OTHER LEGAL ACTION ARISING IN CONNECTION WITH THE USE OF THIS WEB SITE, THE SERVICES OFFERED THROUGH THIS WEB SITE, OR THESE TERMS AND CONDITIONS MUST BE ON AN INDIVIDUAL BASIS, WHERE ALLOWED BY APPLICABLE LAWS.
